PLEASE READ THE FOLLOWING DOCUMENT (HEREINAFTER THE "GENERAL TERMS AND CONDITIONS" OR "T&C") PRIOR TO USING IN ANY FORM THE MASLOW WEBSITE ("THE PLATFORM") OF MASLOW HR INC. (hereinafter "THE COMPANY" or "MASLOW") WITH REGISTERED ADDRESS AT 108 Escalera Parkway, Georgetown, TX, USA.
REMAINING ON THE SITE, AS WELL AS ANY USE OF THE SERVICES PROVIDED THROUGH IT, SHALL BE UNDERSTOOD AS ACCEPTANCE OF ALL THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THEM, YOU MUST REFRAIN FROM ACCESSING AND USING THE SITE AND MASLOW'S SERVICES.
IN ADDITION TO THESE GENERAL TERMS AND CONDITIONS, EACH SERVICE PROVIDED MAY ESTABLISH SPECIFIC TERMS AND CONDITIONS, TO WHICH USERS OF THOSE SERVICES MUST ADHERE. SUCH REGULATIONS MAY SUPPLEMENT, MODIFY, OR OVERRIDE PROVISIONS HEREIN, AND MUST BE UNDERSTOOD TOGETHER WITH THESE TERMS AND CONDITIONS AND THE PRIVACY POLICY AS INTEGRAL PARTS OF A SINGLE DOCUMENT.
1. About the Maslow Platform
1.1 Any reference herein to the "MASLOW Platform" refers to the medium through which THE COMPANY's services are provided, which may include, without limitation: the website https://maslow.hr; the mobile application "MASLOW APP"; and any other medium or technology through which THE COMPANY may provide its services in the future.
1.2 MASLOW is a web-based management platform that allows users to manage and access benefits and compensation assigned by their employer or contracting company. Through the user dashboard, users can voluntarily apply for various types of benefits, products, and services from multiple providers offered in the Maslow MARKETPLACE.
1.3 MASLOW informs Users that: MASLOW does not own the products and services displayed in the MARKETPLACE. MASLOW does not sell or market the products nor provide the services listed in the MARKETPLACE. MASLOW does not hold custody of the products listed in the MARKETPLACE.
1.4 In the Maslow MARKETPLACE, users can find information about products and services, conditions and limitations, applicable prices, search and help tools, feature guides, and much more.
1.5 To access the benefits, products, or services offered in the MARKETPLACE, users must redeem credits assigned by their employer or contracting company. Each benefit, product, or service has a value represented in credits. Once a redemption is made, the credit value will be deducted from the User's account. The User may check their account status at any time through the user dashboard.
1.6 Credits cannot be exchanged for money or any other good or service other than those offered in the MARKETPLACE. Credits are non-transferable and have no commercial value as they are not for sale.
1.7 Products and services offered in the MARKETPLACE by third-party providers are subject to modification, removal, and/or replacement at any time. Consequently, the number, type, quantity, quality, and conditions of access may vary over time without prior notification to users.
1.8 The MASLOW PLATFORM allows users to calculate the economic impact of benefits and view metrics on total compensation including benefits assigned through MASLOW.
1.9 The MASLOW PLATFORM is a software application that runs entirely on THE COMPANY's central servers or those of third-party providers. User access requires a computer or compatible mobile device with internet connection. MASLOW does not require any local software installation.
1.10 Users should note that the functionalities described above may not be available in all countries where MASLOW operates. Similarly, products and services offered in the MARKETPLACE may vary from country to country.
1.11 For certain services or products offered through the Platform's Marketplace, user data may be required. Prior to providing any personal data, the User must review all data processing provisions included in the Privacy Policy.
2. User Status
2.1 User Registration
2.1.1 To become a User, the employer or company for which the User provides services must first create and assign an account on the MASLOW PLATFORM. Upon first login, the User must review these T&C, the Privacy Policy, and any particular provisions, and may only continue the registration process if they accept them in full.
2.1.2 The registration process aims to establish the User's identity and related information. Once registered, the User will have a username and password for personalized, confidential, and secure access. The password must only be used by the User and sharing it is prohibited. The registered User assumes the obligation to safeguard their password and must immediately inform THE COMPANY if it loses confidentiality.
2.1.3 THE COMPANY reserves the right to request additional documentation to verify User data, as well as to temporarily or permanently suspend Users whose data cannot be confirmed.
2.1.4 Each User is responsible for keeping their personal information updated in the registry as necessary.
2.1.5 By registering on the PLATFORM, the User acknowledges meeting the registration requirements and guarantees that all information provided is truthful.
2.1.6 The User is responsible for all operations carried out through their personal account and must immediately notify THE COMPANY of any unauthorized use.
2.1.7 User participation on the PLATFORM is subject to their employer's or contracting company's decision. THE COMPANY merely provides the PLATFORM without involvement in account attribution.
2.1.8 THE COMPANY may reject any registration or service request, or cancel a previously accepted registration, for legal reasons.
2.1.9 In all cases, personal information supplied by Users will be properly treated and preserved in accordance with THE COMPANY's Privacy Policy.
2.1.10 THE COMPANY reserves the right to change, update, or modify registration and access criteria at any time without prior notice.
2.2 Legal Capacity of Users
Only those who, under the laws of their place of residence, can validly consent to contracts may access and use the PLATFORM's services. This capacity is typically acquired at age 18. Those lacking such capacity may not register or use the PLATFORM.
When acting on behalf of a legal entity, the User must have sufficient authority to contract on behalf of the entity.
For student internship memberships, interested parties must be at least fourteen (14) years old. Those aged 14 to 17 may only use the PLATFORM with authorization and supervision of a responsible adult.
3. User Declarations and Responsibilities
3.1 The User guarantees that all declarations made in connection with these T&C are true, complete, and accurate.
3.2 The User is solely responsible for the confidentiality and security of their username and password. The User is also responsible for all activities related to their account. THE COMPANY assumes no responsibility for user account activities.
3.3 The User agrees to use the PLATFORM in accordance with the law and these T&C, and to refrain from using it for unlawful purposes.
3.3.1 Sanctions. Suspension of operations. THE COMPANY may warn, temporarily suspend, or permanently disable a User's account if: a) they breach their commitments; b) THE COMPANY determines fraudulent conduct; c) the User's identity cannot be verified or provided information is false.
3.4 The User agrees to provide MASLOW with all documentation and information required by applicable regulations and to keep it updated.
4. Intellectual Property Rights
4.1 THE COMPANY owns all rights to the PLATFORM. All content, including information, trademarks, trade names, data, texts, graphics, images, designs, photographs, audio, video, logos, icons, software, and databases, are owned by THE COMPANY or third-party rights holders and are protected by international intellectual property laws and treaties. Unauthorized use and total or partial reproduction are prohibited without express written authorization.
4.2 Users may not use any part of the PLATFORM's content for commercial or resale purposes without prior express authorization.
4.3 Use of the name, trademark, or logo of THE COMPANY, THE PLATFORM, and/or the MASLOW Service for any purpose without express consent is prohibited.
5. Changes to the Platform
5.1 THE COMPANY constantly introduces changes to improve and update its services. It may suspend access to the PLATFORM or close it indefinitely if necessary.
5.2 Services provided through MASLOW are subject to modification, removal, or replacement at any time. These changes may be motivated by regulatory changes.
5.3 THE COMPANY reserves the right to modify these T&C at any time at its sole discretion. Continued use after updates constitutes acceptance.
6. Data Protection and Information
6.1 THE COMPANY will protect any personal information received in connection with its services. All personal information will be treated with maximum security and care, in accordance with the Privacy Policy.
7. Account Termination
7.1 Users may cancel their account at any time through the "Account" section in their user dashboard.
7.2 THE COMPANY may, at its sole discretion, cancel a user account and all access without prior notice. If an account is cancelled due to a T&C violation, the User will be liable for resulting damages.
7.3 The User's employer or contracting company may also suspend, cancel, or terminate any user account at will and at any time.
7.4 Accumulated credits have no monetary value and are valid while the account is active. Upon account cancellation, the User has 30 days to redeem accumulated credits. After this period, credits expire automatically.
7.5 Account termination does not affect obligations regarding information preservation, confidentiality, and other relevant T&C provisions, which shall remain in effect. THE COMPANY assumes no responsibility to users or third parties for account cancellation.
8. Disclaimers and Limitations
8.1 MASLOW'S SERVICES ARE PROVIDED SOLELY AS AN AUXILIARY TOOL. THE COMPANY DOES NOT ITSELF PROVIDE THE BENEFITS, SERVICES, OR PRODUCTS LISTED IN THE MASLOW MARKETPLACE. PRODUCT AND SERVICE PROVIDERS ARE THIRD PARTIES. THE COMPANY ASSUMES NO RESPONSIBILITY FOR ANY CONSEQUENCE ARISING DIRECTLY OR INDIRECTLY FROM ANY ACTION OR INACTION BASED ON THE SERVICES, INFORMATION, PRODUCTS, OR OTHER ELEMENTS AVAILABLE THROUGH THE PLATFORM.
8.2 THE USER ACCEPTS THAT USE OF THE PLATFORM IS AT THEIR OWN RISK. IF THE USER DISAGREES WITH ANY PROVISION OF THESE T&C, THEIR SOLE REMEDY IS TO REFRAIN FROM USING THE PLATFORM.
8.3 LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES SHALL THE COMPANY BE LIABLE TO THE USER FOR DAMAGES ARISING FROM OR IN CONNECTION WITH MISUSE OF THE PLATFORM, INABILITY TO USE THE PLATFORM, OR SERVICE INTERRUPTION, SUSPENSION, OR TERMINATION.
9. Platform Availability
9.1 THE COMPANY makes its best efforts to maintain and improve service quality but does not guarantee continuous, uninterrupted provision of the PLATFORM. The User expressly waives any claim based on THE COMPANY's liability for failures, slowness, or errors in service access and use.
10. Changes in Applicable Regulatory Framework
10.1 If any provision of these T&C becomes null, void, or prohibited due to new regulations or changes in existing law, THE COMPANY will take necessary measures to comply, reserving the right to require acceptance of new conditions from Users.
11. Allegedly Unlawful Activities
11.1 Any User or person with a legitimate interest who considers that unlawful activities are occurring on the PLATFORM must send a notification to THE COMPANY containing: a) contact information; b) specification of the allegedly unlawful activity; c) supporting facts; d) personal data of the rights holder if applicable; e) a declaration that the information provided is accurate.
12. Applicable Jurisdiction and Law
12.1 These T&C shall be governed by the laws of the jurisdiction where services are provided.
12.2 The Parties shall make their best efforts to amicably resolve any dispute arising from this agreement.
13. Severability
13.1 If any clause is deemed unenforceable by a competent court, the remainder of the T&C shall remain in full force and effect.
14. Entire Agreement
14.1 These T&C, together with the Privacy Policy and Specific Terms of Use, constitute the complete agreement between the User and THE COMPANY.
15. Electronic Acceptance
15.1 The User acknowledges that by remaining on the site or using the services, they accept this agreement as if they had signed it.
16. Links and Hyperlinks
16.1 To the Site: Any hyperlink from an external website to "https://maslow.hr/" requires THE COMPANY's express authorization.
16.2 From the Site: Hyperlinks on the PLATFORM connecting to third-party websites are intended to enhance the User experience. THE COMPANY does not control or guarantee the security, quality, or suitability of third-party content.
17. Notifications
17.1 For user communications with MASLOW, messages sent to info@maslow.hr shall be considered valid.
17.2 Notifications sent by MASLOW to the postal address or email address provided by the User during registration shall be considered effective and fully valid.
18. Additional Information for Users Residing in Mexico
Service provider: For users residing in Mexico, the service provider through the MASLOW platform is MASLOW HR TECH SA de CV, located at Hacienda El Ciervo 25, Colonia Hacienda Las Palmas, Huixquilucan, Estado de Mexico, Mexico. These Terms and Conditions shall be governed by Mexican law. In case of any dispute, the parties expressly submit to the jurisdiction of the competent courts in Mexico City.
19. Additional Information for Users Residing in Argentina
Terms and Conditions - Prepaid Health Services through the Maslow Platform
The Maslow Platform acts as a marketplace for the acquisition of various benefits and compensation by its users, including health coverage provided by prepaid health companies. The following terms regulate the use of prepaid health services provided by third-party providers through our platform.
19.1 Intermediary: The Maslow Platform is an intermediary facilitating the connection between users and prepaid health companies. We are not the entity providing medical services and have no direct control over service delivery.
19.2 No Liability for Service Delivery: We assume no responsibility for the timely and proper delivery of medical services. Any issues must be addressed directly with the medical service provider.
19.3 Coverage Eligibility: We do not guarantee that platform users will be eligible for medical coverage. Eligibility is subject to the terms established by the medical service providers.
19.4 Direct Agreement with Medical Service Provider: Users interested in medical coverage must agree directly with the medical service providers on terms, conditions, and scope of services. The Maslow Platform does not participate in contract negotiation.
19.5 Not a Party to Medical Service Contracts: The Maslow Platform is not a party to medical service contracts between users and providers. We act solely as a facilitator.
19.6 Claim Handling: Users acquiring medical services through the Maslow Platform acknowledge that any dispute or claim related to medical services must be directed to the relevant medical service provider.
19.7 Absence of Control and Liability: Users acknowledge that the Maslow Platform is not responsible for the quality, availability, efficacy, timeliness, accuracy, or continuity of medical services. Maslow shall not be liable for any direct, moral, consequential, or punitive damages arising from medical service delivery.
